What the City of Delta has put in writing.
Delta sets out what a low lying property has to deal with before anyone builds on it. Here is the short version, taken from the City page that says it.
One
The covenant
For low lying or waterfront property, the City says there may be a restrictive covenant on the title setting a minimum building elevation for habitable space, or minimum setbacks from bodies of water. Any plans for redevelopment must be consistent with the terms of that covenant.
Two
If there is none
Where no covenant exists, the City says you may be required to enter into one at the time of a building permit or as part of a development application.
Three
The dike
The City points to the Dike Maintenance Act, which says changes must not be made to a dike, or to the area next to one, without the prior written approval of the Inspector of Dikes. Delta consults the provincial Dike Safety Program when it reviews a building permit.
Four
Farm buildings
The City says minimum flood construction levels do not apply to agricultural buildings. A covenant can still set a minimum elevation for habitable space on the same property.
Five
The slope
Delta has set development permit areas, a policy and geotechnical requirements for slope stability. The City says the geotechnical consultant specifies the conditions of constructability and the monitoring protocol.
Six
The soil
Where soil disturbance is likely, the City says every application for subdivision, a development permit or a building permit must come with a provincial Site Disclosure Statement. If the Ministry has to review it, Delta cannot approve the application until the Ministry issues a legal instrument or a release.
